Terms & Conditions

1. Business DNA Resources and any of its related parties, companies or businesses (hereinafter collectively referred to as BDNA) has not purported to act as your business advisor or consultant and has not provided personal securities recommendations in relation to any investment products or information.
2. You will seek your own advice as appropriate prior to purchasing any product or acting on any information provided by BDNA. If you do not seek your own advice before purchasing a product or service or acting on information offered by BDNA, you recognize that you are competent to make your own decisions.
3. You expressly waive and relinquish any and all claims of any nature against BDNA, affiliated companies and/or employees arising out of or in connection with your use of any of BDNA's products and services, and any information arising from such use.
4. You agree to indemnify and hold BDNA harmless from any claims or demands of third parties that arise out of your use of BDNA's products and services.
5. The Business DNA Natural Talents Profile or any other Business DNA Profile is not a professional psychological instrument and should not be used to identify, diagnose or treat psychological, mental health, and/or medical problems. Additionally, if used to evaluate personnel, the user should seek adequate legal counsel to ensure compliance with applicable local, state and federal employment laws. The user assumes sole responsibility for any actions or decisions that are made as a result of using these aids to self-discovery.
6. BDNA shall not be liable for any direct, indirect, incidental, special or consequential damages arising from the use of or inability to access BDNA's products or services.
7. BDNA reserves the right to terminate your access to the website at any time on giving notice to you if you commit any breach of these terms and conditions. BDNA will have no liability to you for such termination. Notice may be served by any reasonable method, including email.
8. All profile orders are payable in advance of set-up, unless credit terms have been specifically agreed in advance.
9. There will be a charge of $50 for any failed credit card transactions or returned checks.
   
10. Online purchases of profiles made on any of the Business DNA websites are non-refundable. Any reassignment of profiles to different users will incur an administration fee.
11. Fees for web seminars are required to be paid at least one week before the scheduled training date. A full refund may be obtained with written cancellation notice up to one week before the scheduled training date. Within one week of the training date, a cancellation fee of 50% will be incurred. To re-schedule a web seminar no penalty will be incurred up to one week prior to the program date. The fee for rescheduling is $50 if the request is made between one week and 24 hours prior to the program. All requests must be made in writing. Please note: within the 24 hour window, cancellation or attempt to reschedule is considered a no show which will result in no refund.
12. For classroom sessions, fees are required to be paid at least two weeks before the scheduled training date. A full refund may be obtained with written cancellation notice up to two weeks before the scheduled training date. Within two weeks of the training date, a cancellation fee of 50% will be incurred. To re-schedule, no penalty will be incurred up to two weeks prior to the program date. The fee for rescheduling is $500 if the request is made between 2 weeks and 24 hours prior to the program. All requests must be made in writing. Please note: within the 24 hour window, cancellation or attempt to reschedule is considered a no show which will result in no refund.
13. Memberships to the Advisor and Consultant Communities are all annual subscriptions, regardless of the payment method chosen. 
14. As a professional advisor or as a coach or mentor you may only use the profiles and other resources contained in this website to assist you with the delivery of Business DNA services to your clients and developing your business. Access to this site grants you implicit permission to use the materials in their existing form.  However any material changes to these documents (which potentially alter the message being delivered) should be submitted to us for review before use. By using these materials you are acknowledging our copyright and intellectual property ownership.
    
15. The use of the profiles and other resources for the purposes of training, mentoring, coaching or consulting other business consultants or providing any other facilitation or advisory service to business advisors, coaches or consultants is strictly not permitted without our written permission.
16. All work, information,  ideas, concepts, property, processes, materials, books, know how of any kind that is provided to you by BDNA, or that is developed or modified directly or indirectly in any format or form of media by you or your representatives will be treated as copyright which is owned by BDNA. Copyright will continue to vest in BDNA after the termination of any agreement or provision of products and services in any format. Such processes and property may not be used in an unauthorized manner during or after termination of products and services being provided.
    You acknowledge that BDNA is the owner of all DNA Marks as defined herein.  DNA Marks means right, title, and interest in and to the trademarks, service marks, trade names, domain names, business names, logos, and other descriptive devices of BDNA or directly and indirectly associated with the DNA Discovery Process as designated by BDNA and any other products or services provided by BDNA, including in English and non-English format or variation.
    You covenant not to file or prepare any application for registration of any of the DNA Marks without the prior approval and direction of BDNA.  You agree not to adopt, use, file for registration, or register any trademark, service mark, domain name or tradename (with respect to the DNA Marks or otherwise) without the prior written consent of BDNA.
    You shall not use the DNA Marks in any manner whatsoever except as expressly provided in this Agreement, or with any other trademarks, trade names, service marks, logos, or other similar designations without BDNA’s prior written approval.  The parties agree that all use by you of the DNA Marks shall be in such a manner as to inure at all times to the benefit of BDNA, and shall not in any manner create the impression that the DNA Marks belong to and are owned by BDNA or any other party.
17. All information about BDNA, related companies, company processes, procedures, intellectual property, clients and any other matter arising or coming to your attention or of your representatives must be kept strictly confidential.  Such information must not be released to any person outside the parties.
    The unauthorized release or use of confidential information can result in instant termination of BDNA providing products or services without warning or notice. 
    
18. In the event of termination of BDNA providing services, all accrued fees which are due and payable and expense reimbursements will be paid to the date of termination.
